Contract Terms
SnoStation SARL ‘the Owner’ shall include where appropriate its officers, associates and employees. ‘Group Leader’ refers to the person who makes the reservation, who must be a minimum of 18 years old. "Group" refers to all persons included in the reservation. The Group includes any change of names to the original booking. By making a booking the Group Leader shall be deemed to have accepted the terms of these booking conditions on behalf of the Group. The Group Leader is responsible on behalf of all other members of the Group for all matters relating to the booking.
Payment
‘Acceptable method of payment’ is by bank transfer direct to the bank account of the Owner, or by Visa, MasterCard or Maestro. If paying by credit card there is an extra charge of 3% to cover the Owner’s bank charges. Regardless of payment method, credit card details of the Group Leader or Group will be taken prior to commencement of the holiday to cover damage. See damage section for more details, section 8 and 10 respectively.
No contract shall exist between the Owner and the Group Leader or Group until a minimum of 30% deposit has been received by the Owner through an Acceptable method of payment, and a confirmation email has been sent to the Owner.
Price
The owner guarantees the price of the holiday as quoted at the time of booking. The owner reserves the right to increase or decrease the price of unsold holidays at any time.
Termination
The Owner reserves the right to terminate without notice and liability the holiday of any Group Member whose behaviour is such that it is disruptive to the enjoyment of others or cause damage to the property or any third party. This is entirely at the discretion of the Owner.
Deposit
Upon reservation, the Group Leader or Group must pay a deposit of 30% of the accommodation price quoted within 7 working days, by an Acceptable Method of Payment. This deposit ensures the reservation of the accommodation for the period of the requested stay, until final payment is received.
In the event of cancellation the deposit will not be refunded.
Where reservations are made within 8 weeks of the commencement of arrival, full payment will be required to confirm the reservation.
Final Payment
The remaining balance of the total holiday price, including accommodation and additional services is due and payable by the Group Leader or Group 8 weeks prior to the date of arrival.
Cancellation
The Owner requires written/email cancellation of any bookings from the Group Leader. The cancellation policy is as follows:
50 days or more = loss of deposit
49 – 36 days = Loss of 50% of total holiday price
35 – 22 days = Loss of 75% of total holiday price
49 – 36 days = Loss of 50% of total holiday price
00 – 21 days = Loss of 100% of total holiday price
When absolutely necessary and unavoidable, the Owner reserves the right to change the accommodation type. In event of unforeseen circumstances, the Owner also reserves the right to cancel a Group reservation up until the day of your arrival. In this occurrence the owner will;
a) endeavour to make alternative arrangements for accommodation of the same value if available, or if the Group Leader prefers;
b) offer a full refund of any monies paid for the accommodation
In the event that no alternative arrangements can be made a full refund of any monies paid for the apartment will be made. No other compensation will be offered.
Damage
Prior to commencement of the holiday credit card details of the Group Leader or Group will be taken. In the event that the Owner deems the Group responsible for any material damage or loss to the apartment and/ or building and/ or common parts or its effects during the Groups stay, any cost to rectify damage caused will be charged to the credit card details supplied. An extra charge will also be made where we consider the property is left in an excessively dirty state.
If there are any problems about the condition of the accommodation/ apartment/ chalet and any inventory discrepancy, the Group Leader/ Group should contact the Owner directly on the number available on the website within 24 hours of arrival or occurrence of the problem. The Group is unable to request a change of apartment during their holiday.
Cleaning
‘Cleaning’ is provided for each apartment inclusive in the cost of the holiday and includes, cleaning bathrooms, toilet, kitchen spaces, windows, and floors. It does not include removing opened food / beverages / rubbish from the apartment, or washing dirty crockery, cutlery, glassware, pans and cooking appliances or oven trays. Please remove all rubbish, opened and out of date foods and beverages before checking out of the apartment, and ensure that all crockery, cutlery, glassware, pans/ cooking appliances and oven trays are thoroughly cleaned, dried and put back in their place. An extra charge of EURO 6O.00 will be made to the credit card number taken if this is not done.
Arrival and Departure
All rentals start from 5pm and end at 10am. Apartments cannot be entered until 4.30pm on day of commencement of the holiday or left after 10.30am on the final day of the holiday, unless otherwise agreed with the Owner.
Insurance
It is the responsibility of the Group Leader to ensure that each member of the party is responsible for the safety of all their own personal possessions, documents and equipment. The Owner does not accept any responsibility whatsoever for loss or damage to property and or persons or third parties at any time.
Any injury to the Group Leader or Group or third party arising when inside the apartment is not the responsibility of the Owner.
It is up to the Group Leader to ensure that each member of the Group has all their own necessary medical and travel insurance documents to cover themselves fully before embarking on the holiday. No responsibility is or will be accepted by the Owner in respect of any such failure to insure wheresoever or howsoever arising.
It is a requirement under French law, that no children under the age of six years are to sleep in the upper bunk of bunk beds. If they do and injury arises, the liability is totally dependent on the guardians of that child.
Force Majeure
The Owner does not accept any liability wheresoever or howsoever arising or pay compensation for:
a) any event which the Owner could not foresee or avoid. Such events include war, threat of war, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions such as lack of snow, and fire;
b) any cancellation, loss, delay or costs wheresoever or howsoever arising or connected with adverse weather or traffic conditions, avalanche, mud slips, slides and snow conditions and the effect any of these may have on travel arrangements, accommodation and activities;
c) limitations imposed by resort authorities, ski-lifts, ski school or ski hire operators;
d) travel arrangements made by the Group or on behalf of the Group.
The Owner does not accept any liability for personal injury or death wheresoever or howsoever arising caused to any visitor and/or any member of the Group for their duration of stay in the apartment. This is not intended to exclude any statutory rights the Group and/or visitor may have.
Law
This agreement and any proceedings thereunder are to be governed by the laws of France and any legal issues to be determined by the courts of France.
